Resumen
The purpose of this article is to analyse the right of access to public information with particular reference to public contracts and its often invoked confidentiality clause. To do so, it begins with the standards developed by the Inter-American Court of Human Rights in relation to this right, linking them to Uruguayan internal regulations and focusing on its limits. It examines the main tools used to control restrictions on this right, such as the principle of proportionality and the harm test. It postulates that the inclusion of a confidentiality clause is not sufficient to exempt certain data from public access, but that a more in-depth examination is necessary, in which specific tools should be applied. The article analyses as an example the case of the acquisition of vaccines for COVID-19, applying the mentioned parameters for their control and resolution, which go beyond this case and the Uruguayan State.
